1. Who we are

novfort.com and design.novfort.com are run by NovFort Limited, a company incorporated in Hong Kong (company no. 81276802), business registration certificate no. 81276802-000-09-26-A, registered office Rm S045, 2/F The Capital, 61–65 Chatham Road South, Tsim Sha Tsui, Kowloon, Hong Kong ("NovFort", "we", "us"). When you order, your contract is with NovFort Limited.

2. These terms

These terms apply when you use our sites or buy from us. Our Refund policy, Shipping policy and Privacy policy form part of them. Nothing in these terms excludes, restricts or changes any right you have under the Australian Consumer Law or any other law that can't be excluded.

3. Our products and the Designer

We sell interlocking garage floor tiles, 40 × 40 cm, in three Models (3D, Solid and Ribbed), with edge ramps (40 × 6 cm) and corners (6 × 6 cm) to finish the edges. Colours on screen are as close as we can make them, but screens vary.

The Designer works out what a floor needs from the measurements you give it. It counts every cut tile as a whole one and tells you which ramps go where. Its counts are only as accurate as your measurements, so please measure carefully before you order.

4. Prices

Prices are in Australian dollars and include GST. We don't run fake sales or show made-up "was" prices. The price you see when you place an order is the price you pay. If we make an obvious pricing mistake, we'll contact you before your order ships, and you can pay the correct price or cancel for a full refund.

5. Orders, pre-orders and payment

You pay in full when you order, by card or through the other options shown at checkout. Payments are processed by Airwallex through Shopify's checkout. Your order is accepted when we send the order confirmation email.

While our first stock is on its way to Australia, orders are pre-orders. We state the delivery window before you pay, and a pre-order is refundable in full until it ships. If we can't supply an order, we'll tell you and refund it in full.

6. Delivery

We deliver within Australia only, as set out in our Shipping policy. Risk in the goods passes to you on delivery. Ownership passes to you once we've received payment in full.

7. Returns and refunds

See our Refund policy. We don't take change-of-mind returns after delivery. Faulty, damaged and wrong items are always put right.

8. Our 15-year Quality Guarantee

This guarantee is given by NovFort Limited, Rm S045, 2/F The Capital, 61–65 Chatham Road South, Tsim Sha Tsui, Kowloon, Hong Kong, contactable at contact@novfort.com.

We guarantee that our tiles, used as a floor in a home garage, will be free from manufacturing faults and won't crack in normal use for 15 years from the date they're delivered.

What we do: if a tile fails within the guarantee, we send you replacement tiles of the same Model and colour, or the closest we then make, and we pay the postage.

What it doesn't cover: commercial or industrial use; damage from chemicals, solvents or fire; marks from hot tyres; damage from accidents, misuse, or installation that doesn't follow our instructions; normal wear and fading; and the cost of removing or relaying tiles.

How to claim: email contact@novfort.com with your order number and photos of the affected tiles. You pay nothing to make a claim. If we need a tile back to look at it, we pay the freight.

The benefits of this guarantee are in addition to other rights and remedies you have under the law in relation to the goods.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9. Our liability

To the extent the law allows, we're not liable for loss that wasn't reasonably foreseeable, or for loss caused by something outside our reasonable control. Where the law allows us to limit our liability for goods that aren't ordinary consumer goods, our liability is limited to replacing the goods or paying for replacements. None of this limits your rights under the Australian Consumer Law.

10. Using our sites

Please don't misuse our sites: don't try to break them, overload them or copy them for commercial use. The NovFort name, logo, site content and the Designer belong to NovFort Limited. Designs you make in the Designer are yours to keep and share.

11. Governing law

These terms are governed by the laws of Hong Kong. If you're a consumer in Australia, you keep the protection of the Australian Consumer Law and of the laws of the state or territory where you live, and you can bring a claim in your local courts.

12. Changes

We may update these terms from time to time. The version in force when you place an order applies to that order.
